High Court Orders Electoral Commission to Re-Collate Results in Tema Central Constituency

Jh News: In a significant development, the High Court in Accra has granted the New Patriotic Party's (NPP) application to compel the Electoral Commission (EC) to re-collate constituency results in the Tema Central Constituency. This ruling is part of a larger mandamus application concerning four constituencies, including Tema Central, Okaikwei Central, Techiman South, and Ablekuma North.

According to Justice Forson Agyapong, the EC failed to collate results from all polling stations in Tema Central before declaring a winner. Furthermore, the person who declared the winner was not the authorized returning officer, as required by electoral laws. The judge also noted that there was evidence of the EC's refusal to act on demands to re-collate the results.

As a result, the court has ordered the EC to re-collate the results of two outstanding polling stations and add them to the existing results. Additionally, the Inspector General of Police (IGP) has been directed to provide adequate security for the EC to carry out this task.

This ruling comes after the National Democratic Congress (NDC) had claimed that its candidate, Ebi Bright, won the election fairly. However, the court's decision has paved the way for a re-evaluation of the results in Tema Central ¹.
