Former Chief Justice Gertrude Araba Esaaba Sackey Torkonoo has filed an application for judicial review at the High Court in Accra, contesting her removal as a Justice of the Supreme Court.

In the motion filed on 17 September 2025, Justice Torkonoo argues that the President lacked the constitutional authority to remove her from the Supreme Court bench without following the procedures outlined in Article 146 of the 1992 Constitution.

She is seeking a declaration that:

  • The President’s September 1, 2025 Warrant of Removal is unlawful, null, and void.
  • Only a body constituted under Article 146(4) has jurisdiction to hear petitions for the removal of a Justice of the Superior Courts.

Justice Torkonoo is not contesting her removal as Chief Justice, but specifically her status as a Supreme Court judge, insisting the constitutional process was breached.
